Sundowner Trailer 8/2 Year Limited Warranty

  1. WHAT IS COVERED:
    Sundowner Trailers, Inc. expressly warrants to you, the original purchaser of a Sundowner trailer, that on the date of purchase by you, the product was free from defects in the composition of material and workmanship, and was in accordance with industry standards of such products.
    1. Structural - 8 Years Recreational, 1 Year Commercial
      This warranty covers the main trailer structure, consisting of the side rails, floor cross members, sidewalls and subframe.
    2. Components and Hardware - 2 Years Recreational, 1 Year Commercial
      All other parts and components manufactured by Sundowner that attach to the main trailer structure such as doors, gates, floors, cabinets and dividers.
    3. Electrical - 1 Year
      Wiring, connections and lights
    4. Sealants - 1 Year
      Manufacturer warrants that a trailer’s roof sealants and caulking will be free of defects in material and workmanship for 1 year from date of original purchase. After 1 year, all sealants and caulking are a maintenance item.
    5. Other Manufacturers’ Warranties
      Items which are not manufactured or constructed by Sundowner, including but not limited to generators, batteries, axles, coupler, jack assembly/landing gear, wheels and tires. If these items are warranted by the manufacturer or supplier thereof, and such warranty may be extended to the original purchaser, Sundowner will make such warranties available.
    6. Sundowner Living Quarter Package Conversions - 2 Years
      Sundowner living quarter package conversions are covered by the 2 Year limited warranty. This limited warranty applies only to materials and components originally built or installed by Sundowner. The limited warranty does not cover components that are not manufactured by Sundowner including but not limited to appliances, televisions, air conditioners, generators, batteries and converters. These items are covered under the warranty by the component manufacturer.
      Mold can occur as a result of high humidity, condensation or water intrusion. Prevention of mold is a maintenance issue and is the customer’s responsibility. Therefore, damages resulting from mold are not covered by the Sundowner Limited Warranty.
      Freeze warnings that create potential danger to pipes or other interior items are also not covered under the Sundowner Limited Warranty. It is the customer’s responsibility to ensure preventative measures are taken in the event of extreme temperature changes.
  2. DURATION OF THIS WARRANTY AND NOTICE REQUIREMENTS:
    This limited warranty is applicable to defects in components manufactured by Sundowner, and which are not excluded in above mentioned paragraphs of this limited 8/2 year warranty, and which defects are discovered within a period of 8 years on Sundowner aluminum trailers. These warranties apply to the case of the main trailer structure and a limited manufacturers warranty on non-Sundowner parts, from the purchase date indicated on the reverse side of this limited warranty. For service, contact the Sundowner Dealer from whom you purchased the trailer.
  3. REMEDIES AVAILABLE FROM SUNDOWNER:
    In the event of a defect in material or workmanship covered by this warranty, Sundowner, in its sole discretion, will:
    1. Correct the defective work or replace the defective part on a no-charge basis.
    2. Reimburse the original purchaser by paying a sum not exceeding the price charged by Sundowner for such work.
    3. Provide for repair of the defect or replacement of the defective parts by an authorized dealership or service shop.
    4. Sundowner, may at this option, require the defective part or trailer to be returned to the plant in Oklahoma for repairs. All transportation charges in connection with a warranty claim will be the sole responsibility of the original purchaser.
  4. REMEDIES NOT AVAILABLE FROM SUNDOWNER:
    The obligations stated in the preceding paragraph are sole exclusive remedies available from Sundowner, in the event a warranty should occur. Sundowner will not be liable for any special, incidental or consequential damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory. Sundowner reserves the right to make changes in design or make additions and/or improvements to its product without being obligated to make similar installations or modifications to products covered by this warranty.
  5. WHAT IS NOT COVERED BY THIS WARRANTY:
    • Damage or loss caused, in whole or in part, by failure to check and torque lug nuts properly.
    • Damage or loss caused, in whole or in part, by accident or negligence or by the abuse, misapplication or misuse or the trailer or any of its component parts.
    • Any transportation charge to or from factory or service center.
    • Normal wear items due to wear. These items include, but are not limited to, bearings, brakes, brake linings, or attaching brake parts.
    • Items which are not manufactured or constructed by Sundowner, including but not limited to assembled, axles, coupler, jack assembly/landing gear, wheels and tires. If these items are warranted by the manufacturer or supplier thereof, and such warranty may be extended to the original purchaser, Sundowner will make such warranties available.
    • Damage or loss caused, in whole or in part, by environment, road elements, improper wash solvents, sand, salt, acid rain, salt damage, excessive heat/cold or acts of God.
    • Any consequential or incidental damages incurred as a result of any defect, to include loss of time, inconvenience, loss of use of vehicle, damage to contents of any trailer product, or any other fees incurred by purchaser relating to any warranty claim.
  6. WHAT WILL VOID THIS WARRANTY:
    MODIFICATIONS, ALTERATIONS, MISUSE, NEGLECT, OVERLOADING, UNAUTHORIZED REPAIRS, OR FAILURE TO PROVIDE NORMAL MAINTENANCE SHALL VOID THIS WARRANTY. Weights, dimensions, capacities and other measure stated in connection with the new trailer are only estimates and are not covered by this warranty.
  7. NO OTHER WARRANTIES:
    THIS AGREEMENT IS THE COMPLETE AND EXLUSIVE AGREEMENT BETWEEN YOU AND SUNDOWNER TRAILERS, INC. CONCERNING THE ALLOCATION OF THIS RISKS OF DAMAGE OR LOSS ARISING FROM COMPONENT DEFECTS. THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS AND NO ONE IS AUTHORIZED TO MAKE ANY FURTHER OR ADDITIONAL WARRANTIES ON BEHALF OF SUNDOWNER TRAILERS, INC.
  8. THIS AGREEMENT ALLOCATES THE RISKS OF DAMAGE OR LOSS ARISING FROM PRODUCT DEFECTS BETWEEN SUNDOWNER AND PURCHASER AND THIS ALLOCATION IS RECOGNIZED BY BOTH PARTIES.
  9. Any controversy or claim arising out of or relating to this warranty, or the breach thereof, shall be settled by mandatory arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Purchaser shall retain the right to seek relief concerning this claim in small claims court within the scope of its jurisdiction. The arbitrator will be chosen in accordance with the rules governing each dispute. The arbitration shall occur at location determined by the AAA unless the consumer requests a telephonic hearing.
    The AAA will supply the form, or a Submission to Dispute Resolution form, free of charge on request but arbitration may also be initiated through ordinary correspondence to the American Arbitration Association, 13455 Noel Rd. Suite 1750, Dallas Texas 75240 provided that all the essential information is included. These forms and addresses can also be obtained through the Association’s Website located at www.adr.org.

To qualify for protection under the Sundowner trailer warranty; the registration information form must be completed, signed and submitted to Sundowner within ten (10) days from the date of sale to the original purchaser.
